These Terms of Service (“Terms”) govern your use of the Onty Kenya (“Onty”, “we”, “us”) online store. By using our website or placing an order, you agree to these Terms. Please read them carefully.

Eligibility

You must be at least 18 years old (or have the consent of a parent or guardian) to make a purchase on our store.

Your Account

  • You are responsible for providing accurate and up-to-date information.
  • Keep your login details secure — you are responsible for activity under your account.
  • Tell us promptly if you believe your account has been used without your permission.

Products & Pricing

  • All prices are shown in Kenyan Shillings (KES) and include any applicable taxes.
  • We work hard to display products, prices, and availability accurately, but errors can happen. We may correct errors and update prices at any time before you place an order.
  • Many of our pieces are one-off or limited — once sold, they may not be available again. Availability is not guaranteed until your order is confirmed.

Orders

When you place an order, you are making an offer to buy. We may accept or decline any order (for example, if an item is unavailable or we suspect fraud). Your order is confirmed once we accept it and payment is received.

Payment

We accept payment via M-Pesathrough Safaricom’s secure STK push. When you confirm payment on your phone, you authorise the charge for your order total. Orders are processed only after payment is confirmed.

Delivery

  • We deliver within Kenya, to pickup stations or the address you provide.
  • Delivery timelines shown at checkout are estimates and may vary due to factors outside our control.
  • Risk in the goods passes to you once the order is delivered or collected. Please check your items on receipt.

Returns & Refunds

Returns and refunds are covered by our Return Policy, which forms part of these Terms.

Intellectual Property

All content on this website — including the Onty name, logo, text, and images — belongs to Onty or our partners and is protected by law. You may not copy, reproduce, or use it without our written permission.

Acceptable Use

You agree not to:

  • Use the store for any unlawful or fraudulent purpose.
  • Interfere with, damage, or attempt to gain unauthorised access to the website.
  • Copy or misuse our content or another user’s information.

Limitation of Liability

To the fullest extent permitted by law, Onty is not liable for any indirect, incidental, or consequential loss arising from your use of the store. Nothing in these Terms limits any rights you have that cannot be excluded under Kenyan law.

Governing Law

These Terms are governed by the laws of Kenya, and any disputes will be subject to the jurisdiction of the Kenyan courts.
